Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FitMyWall’s website, web application, and Shopify app (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. The Service

FitMyWall lets you preview artwork at true scale on a photo of a wall, and lets merchants offer that preview to shoppers on their storefronts. Previews are visual approximations and may not perfectly reflect real-world colour, lighting, or scale.

2. Accounts

• You must provide accurate information and keep your credentials secure.
• You are responsible for activity under your account.
• You must be at least 16 years old (or the age of majority in your jurisdiction).

3. Subscriptions & billing

• Web app plans are billed through Stripe on a recurring basis until cancelled.
• Shopify app plansare billed through Shopify’s Billing API and appear on your Shopify invoice.
• Fees, plan limits, and any usage allowances are described at checkout. We may change pricing with notice; changes apply to subsequent billing periods.

4. Acceptable use

You agree not to:

• Upload content you do not have the rights to use, or that is unlawful or infringing.
• Reverse-engineer, disrupt, overload, or attempt to gain unauthorised access to the Service.
• Use the Service to build a competing product or to scrape data at scale.

4a. Fair use

All plans include unlimited artwork uploads, edits, repositioning, resizing, comparisons, saved versions and exports — your plan is priced only by the number of Active Spaces(saved rooms) you keep active. To keep the Service fast and reliable for everyone, we may apply reasonable internal safeguards to prevent abuse, including (without limitation): extremely large artwork libraries, excessive automated or programmatic usage, and activity that degrades the Service for other customers. These safeguards are not advertised plan limits and will only ever affect accounts engaged in abnormal or abusive use. If your legitimate usage approaches any such threshold, we’ll reach out to find a plan that fits.

5. Your content

You retain ownership of the images and content you upload. You grant us a limited licence to process, store, and display that content solely to provide the Service to you. You are responsible for ensuring you have the rights to any artwork or photos you upload.

6. Intellectual property

The Service, including its software, design, and trademarks, is owned by FitMyWall and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service.

7. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not warrant that previews will be accurate, that the Service will be uninterrupted or error-free, or that it will meet your requirements.

8. Limitation of liability

To the maximum extent permitted by law, FitMyWall will not be liable for indirect, incidental, special, or consequential damages, or for any loss of profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to protect the Service. On termination, your right to use the Service ends.

10. Changes

We may update these Terms. Material changes will be reflected by the “Last updated” date, and continued use after changes constitutes acceptance.

11. Governing law

These Terms are governed by the laws of [your jurisdiction], without regard to conflict-of-laws rules.
